Agreement to these Terms

These Terms and Conditions (“Terms”) govern your access to and use of the Acous websites, applications, business communications platform, and related services (collectively, the “Services”). By creating an account, accepting an order, or using the Services, you agree to these Terms and our Privacy Policy.

If you use the Services for an organization, you represent that you have authority to bind that organization, and “you” includes that organization. If you have a separate written agreement with Acous, that agreement controls to the extent of a conflict.

Eligibility and accounts

You must be at least 18 years old and able to enter into a binding agreement. You are responsible for accurate account information, safeguarding credentials and devices, configuring authorized users and permissions, and promptly notifying us of suspected unauthorized access.

You are responsible for activity in your account and for ensuring that your users comply with these Terms.

The Services

Acous provides tools for business calling, messaging, call routing, voicemail, AI-assisted communications, summaries and outcomes, integrations, and related workflows. Features may depend on your plan, location, telecommunications providers, connected services, or technical requirements.

AI-generated content may be incomplete or inaccurate. You are responsible for reviewing outputs before relying on them or using them to make decisions or take external actions.

Acous SMS Program Terms

Program name: Acous Account and Customer Care Messaging.

Program description: Recurring, non-promotional text messages may include account and service notifications, missed-call or post-call outcomes, requested follow-up details, appointment or service-status updates, secure links, and customer-care responses.

How to enroll: Text START to +1 (929) 725-3362. By doing so, you expressly consent to receive recurring SMS messages from Acous at that number. Consent applies only to this Acous program, is not transferable, and is not a condition of purchase.

Message frequency: Message frequency varies based on account activity and your interactions with Acous.

Charges: Message and data rates may apply.

Opt out: Reply STOP at any time. After your request is processed, you will receive a confirmation and no further program messages unless you opt in again.

Help: Reply HELP for assistance or email identity@acous.ai.

Carrier disclaimer: Carriers are not liable for delayed or undelivered messages. Delivery is subject to carrier availability and is not guaranteed.

See the Mobile messaging privacy section of our Privacy Policy. Mobile numbers and messaging consent are not shared with third parties or affiliates for marketing or promotional purposes.

Your responsibilities

You must use the Services lawfully and obtain all notices, permissions, and consents required for your communications, recordings, transcriptions, messages, data, and use of AI. You are responsible for the content you submit and for configuring the Services consistently with your obligations.

You may not use the Services to send spam or unlawful messages; harass or deceive others; facilitate fraud, abuse, or prohibited content; interfere with the Services; probe or bypass security; misrepresent caller identity; violate telecommunications or recording laws; or infringe another person’s rights.

Customer data and privacy

You retain your rights in content and data submitted to the Services (“Customer Data”). You grant Acous the rights needed to host, process, transmit, display, and otherwise use Customer Data to provide, secure, support, and improve the Services as permitted by your agreement and applicable law.

You represent that you have the rights and permissions necessary for Acous to process Customer Data according to your instructions. Our handling of personal information is described in the Privacy Policy.

Third-party services

The Services may interoperate with telecommunications carriers, identity providers, AI providers, payment processors, and other third-party services. Their services may be governed by separate terms and may change or become unavailable. Acous is not responsible for third-party services outside our control.

Fees and payment

If you purchase paid Services, you agree to pay the fees, usage charges, taxes, and other amounts described at purchase or in your order. Except where required by law or expressly stated otherwise, fees are non-refundable. We may suspend paid features for overdue amounts after providing any notice required by your agreement or law.

Ownership

Acous and its licensors own the Services, software, documentation, designs, and related intellectual property, excluding Customer Data. Subject to these Terms, Acous grants you a limited, non-exclusive, non-transferable, revocable right to use the Services during your subscription or authorized access.

Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” Acous disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free operation, guaranteed message or call delivery, or the accuracy of AI-generated content.

Limitation of liability

To the maximum extent permitted by law, Acous will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business interruption. Acous’s aggregate liability arising from the Services will not exceed the amounts you paid Acous for the Services giving rise to the claim during the 12 months before the event giving rise to liability. These limits do not apply where they are prohibited by law.

Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access if you materially breach these Terms, create security or legal risk, fail to pay amounts due, or use the Services in a way that may harm Acous, our providers, or others. Provisions that by their nature should survive termination will remain in effect.

Changes to these Terms

We may update these Terms to reflect changes to the Services, law, or business practices. We will post the updated Terms and revise the “Last updated” date. If a change is material, we may provide additional notice. Continued use after the effective date of updated Terms constitutes acceptance where permitted by law.
